Been quite a while since I've been here and a fair bit has been happening but no good result as yet. I am tempted to buy switches / wires but while still going through stuff with Nissan I don't want to have traces of wires being soldered, etc.
So far Nissan have tried to alter the G force sensor, no change in behaviour and the dealer admitted he wasn't expecting any but had to follow what Nissan required him to do and then told me that there was no other solution.
I spoke with NSW Dept Fair Trading, they put me onto the NSW Consumer, Trader and Tenancy department. Their guidelines are that each party to a dispute must listen to the other party, put their points forward and have suggestions on how to settle the dispute. I have been following these steps and done everything in writing as much as possible and following phone calls have followed up the phone call with a summary of the conversation which has taken place.
Outcomes to date:
They have listened to me, I have listened to them. I think they listen to words, not to the problem. I feel like I am talking to a wall and a robot is answering me. They certainly do not understand the dangerous implications that this issue could have to those of us who use them for 4wding in anything other than level terrain.
I have put forward all my points including some info gained from here regarding what their own vehicle handbook says. Their point basically boils down to "it is what it is".
AS far as making suggestions on how the dispute be resolved I have offered a few alternatives such as installation of downhill descent control (not that I like electronic gadgets doing my driving for me) as fitted in the Pathfinders with the same engine and who don't suffer the same issue through to buying back the vehicle at a price that allows for the use I have had from the vehicle since I purchased it. Nissans suggestion is that I put up with it, in other words, they have no suggestion as to how to resolve a dispute.
The next step is to lodge a complaint with the department. Those whom I have spoken to there seem to think that because I have followed their advice and Nissan have not, there is a good chance a determination will be made in my favour. I just don't know what that will be. I do love the car, fantastic in all respects other than that one little issue. Any other twin cab style vehicle just won't be as good in so many other areas but at least they should be safe to drive.
