St 2012 d40 limp mode

Hi all I have a brand new 2012 d40 which I transferred my old chipit chip off last years model, it's dropped into limp mode 3 times now. I turn the car off and start it again and it's fine it only seems to happen when I put my boot into it.any suggestions.

Just to make sure it's not the chip, disable it and see if it does it again.

Just out of curiosity does it come up on dash as limp mode or does it just not go anywhere when you put your foot down.

If it still does it with the chip off just take it to the dealer, my 09/12 build just got back from the dealer after the 2 EGT sensors went and apparently it's not uncommon....
